Named a panty perpetrator, Victoria's Secret, a division of Limited Brands (LTD) has found itself in the middle of litigation when a piece of metal (yep, you read that right... a piece of metal) flew off the panties, hitting the wearer in the eye. Although a freakish occurrence, it could be a costly one. Litigation is an ugly reality that should keep companies and investors on guard. Taser (TASR) is a company frequently and mercilessly zapped by lawsuits. Fending off all 70 suits brought against it, Taser was recently found 15 percent at fault for the cause of death, costing the company $1.02 million in damages. After the guilty verdict, shares of Taser fell 7.5 percent the morning after the announcement and 25 percent in the following three weeks. Taser is currently hanging out at 9 cents above its 52 week low. Before you toss out Victoria's Secret like yesterday's underwear, let's remember what happened to McDonald's stock performance after the famous coffee litigation case where a woman scalded her groin with McDonald's (MCD) coffee. After the jury awarded the coffee victim $2.86 million, which the court reduced to $640,000, the stock stealthily climbed over 300 percent in the six years that followed. I guess people like their coffee hot. Litigation can be financially debilitating. If the product becomes tainted by too much negative publicity, people will simply stop buying it. If law enforcement stops using tasers because of public outrage, the effect could be heart-stopping for the company. However, if the basis for litigation is as skimpy as a pair of V.S. undies and doesn't mar the overall image of the product, the long-term financial effect is likely to be minimal.
